1. About the service
RetailOS is a cloud retail management system: point of sale, product and stock accounting, customer records, purchasing and reports, together with the public RetailOS Market storefront where companies publish product listings and buyers browse them, follow shops and message sellers.
The Service is under active development; we announce notable changes in the interface.
2. Definitions
- “Service” — the RetailOS web application and the RetailOS Market storefront.
- “Company” — an organisation or sole trader that has created a workspace in the Service.
- “User” — an owner or member of staff of a Company holding an account in the Service.
- “Buyer” — a storefront visitor with a personal account and no Company.
3. Registration and accounts
An account (email and password) is required. You undertake to provide accurate details and not to share your credentials; actions taken from your account are deemed to be yours. Staff join a Company only by invitation from its owner or administrator, and their permissions are limited by the role assigned to them.
4. Pricing and payment
The Service is provided on a subscription basis. Current pricing is shown in the Service under “Subscription”, where payment is also arranged. There are no hidden charges: renewal always requires an explicit action by the Company.
Individual companies may be granted a free trial period. When it ends, access to features is restricted until payment; the Company’s data is retained for the periods set out in section 8.
5. Acceptable use
The Service must not be used for:
- selling goods that are prohibited or restricted by law;
- infringing third-party rights, deceiving buyers or publishing false information;
- attempting unauthorised access to the data of other companies or buyers;
- automated data collection, sending spam, or circumventing technical limits;
- bulk or unsolicited messaging through connected messaging services, or any action that breaches the rules of the messaging service concerned.
In the event of a material breach we may restrict or suspend access, having given prior notice by email — or immediately where other users are at risk.
6. Connected services (Instagram and other messengers)
A Company may connect its own messaging accounts to the Service. The connection is performed by the Company itself through the official authorisation flow of the service concerned; the Operator does not request or store passwords for such accounts.
The Company confirms that it is entitled to control the account being connected and is solely responsible for complying with the rules of the messaging service concerned, including the Meta Platforms policies applicable to Instagram.
The Operator does not sell, buy or license data obtained through connected services and does not transfer it to third parties for advertising, brokerage or any other purpose unrelated to providing the Service to the Company. The contractors that process such data on the Operator’s behalf are disclosed in the privacy policy.
When a channel is disconnected the access token is erased immediately, and messages and identifiers received through it are deleted within 30 calendar days. A user of the messaging service may request deletion of their data directly — the procedure is described on the data deletion page.
RetailOS is not affiliated with Meta Platforms, Inc., Instagram, WhatsApp or Telegram and does not act on their behalf.
7. RetailOS Market storefront
The Service is a technical platform: the contract of sale is concluded directly between the selling Company and the Buyer. The Service is not a party to that transaction and does not accept payment under it. The seller is responsible for the accuracy of listings, prices and availability, and for performing its obligations to the buyer. Storefront chat must remain within the bounds of business communication; where a complaint is made we may review the contents of the conversation concerned.
8. Company data
Products, sales, customer records and other operational data belong to the Company. Companies’ data is isolated from one another at the database level. At the request of a Company’s owner we will provide an export of its data in machine-readable form. Processing of personal data is described in the Privacy Policy.
9. Availability and support
The Service is provided “as is”. We aim for round-the-clock availability, take database backups and give notice of planned maintenance, but we do not guarantee uninterrupted operation. Support requests go to the contact in section 12.
10. Limitation of liability
We are not liable for lost profits, indirect losses, or interruptions caused by circumstances beyond our reasonable control. Our aggregate liability is limited to the amount actually paid by the Company over the preceding 12 months (during a free trial period, nil, except where the law does not permit such a limitation).
11. Changes to these terms
We may update these terms; we will give notice of material changes in the Service interface or by email at least 7 days in advance. Continued use after the changes take effect constitutes acceptance of them.
12. Operator, governing law and disputes
Operator of the Service: Abdulaziz Kydyraliev, sole proprietor, Keremet Street 77/8, Kok-Zhar, Oktyabrsky district, Bishkek, Kyrgyz Republic, tax ID 22103200750536. Support: support@retailos.kg.
These terms are governed by the law of the Kyrgyz Republic. The parties will seek to resolve disputes by negotiation; failing agreement, a dispute is to be heard by the court at the Operator’s location.
